How does your lawyer get paid if you’ve been injured?

In personal injury cases, like car or truck accidents, Contigo Centro Legal works on what is called a contingency fees basis. This means that the client does not pay any money upfront to our law firm. This also means that the client does not pay any money unless the attorney recovers compensation for the client, via settlement or a judgment. In other words, if the client does not win, then the client owes nothing to the attorney. 

In contrast to an hourly fee, under a contingent fee arrangement, the attorney gets a percentage of the eventual recovery, which is typically 33%–40% of any settlement or judgment collected. The attorney also will require reimbursement of any case-related expenses (such as court reporter costs at a deposition, court costs, filing fees, postage, etc.). 

A contingency fee arrangement provides access to legal help and to the court system for injured clients who cannot pay for an attorney. It also serves as motivation for our attorneys to work diligently to obtain a settlement or recovery for our clients. If we do not win a client’s personal injury case, then the client pays nothing for the work done on the case. It also means our law firm is required to pay all expenses associated with the case. A contingency fee arrangement puts all the risk on our law firm, not on our clients.

Clients benefit from a contingency fee arrangement because:

  • No upfront fees. Contingency fee arrangements give people access to high-quality legal representation who could not otherwise afford or pay upfront for legal counsel.

  • Incentive. The attorneys are incentivized to succeed for their clients because if they do not win the case, they do not get paid.

  • No costs to clients for losses. The law firm or attorney assumes all the risk and clients pay nothing unless the attorney wins their case. This means the attorney will not collect a fee if he or she does not win your case.

  • No out-of-pocket payment to the attorney. Any fees owed to the attorney are paid from the recovery or settlement clients are awarded at the end of the case.
